Personal data protection
Article I. Basic Provisions
The controller of personal data is USA NUTRITION GROUP LLC, Northwest Registered Agent LLC, 90 State Street, Suite 700, Office 40, Albany, NY, 12207, United States of America (hereinafter referred to as the "Controller"), operating the online store hardmass.cz.

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, identification number, location data, network identifier or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Although the controller of companies is based in the United States of America, when processing personal data of customers from the European Union, it proceeds in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, "GDPR") and Act No. 110/2019 Coll., on the processing of personal data.
Article II. Sources and categories of processed personal data
The Controller processes the personal data that you have provided to the Controller or the personal data that the Controller has obtained on the basis of the processing of your order — in particular, identification and contact data and data necessary for the performance of the contract (name, address, e-mail, telephone, data on the ordered goods and payment).
Article III. Legal basis and purpose of personal data processing
The legal basis for the processing of personal data is:
- performance of the contract between you and the controller pursuant to Art. 6 para. 1 lit. b) GDPR,
- the legitimate interest of the Controller in the provision of direct marketing (in particular for sending commercial messages and newsletters to existing customers) pursuant to Article 6 (1) of the GDPR. 1 (f) of the GDPR,
- Your consent to processing for the purpose of direct marketing (in particular the sending of commercial communications and newsletters) pursuant to Article 6 (1) (a) of the GDPR. 1 (a) GDPR in the event that no goods or services have been ordered.
The purpose of the processing of personal data is the processing of your order and the exercise of rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for its successful execution are required, the provision of personal data is a necessary requirement for the conclusion and performance of the contract — without their provision it is not possible to conclude the contract or perform it by the Controller — as well as the sending of commercial communications and the performance of other marketing activities.
Article IV. Personal data retention period
The Controller stores personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship, or for the period required by tax and accounting regulations). After the expiry of the retention period, the Controller will delete the personal data.
Article V. Recipients of personal data
The recipients of personal data are persons:
- involved in the delivery of goods/services or the execution of payments based on a contract (carriers, payment gateways),
- ensuring the operation of the e-commerce platform and related IT services,
- providing marketing services.
The Controller does not intend to transfer personal data to a third country outside the EU/EEA or an international organisation, with the exception of the processors mentioned above, which provide adequate data protection guarantees.
Article VI. Your rights
Under the terms of the GDPR, you have:
- the right to access your personal data pursuant to Article 15 of the GDPR,
- the right to rectification of personal data pursuant to Article 16 of the GDPR or restriction of processing pursuant to Article 18 of the GDPR,
- the right to erasure of personal data pursuant to Article 17 of the GDPR,
- the right to object to processing pursuant to Article 21 of the GDPR,
- the right to data portability pursuant to Article 20 of the GDPR,
- the right to withdraw consent to processing in writing or electronically to the Controller's e-mail address referred to in Art. I.
You also have the right to lodge a complaint with the Data Protection Authority (www.uoou.cz) if you believe that your right to data protection has been violated.
Article VII. Security of personal data
The Administrator declares that it has taken all appropriate technical and organizational measures to secure personal data. The Administrator declares that only persons authorized by the Administrator have access to personal data.
Article VIII. Final provisions
By submitting an order from the online order form, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in full.
The Administrator is entitled to change these terms and conditions. The new version will be published on its website.
This policy is valid and effective as of September 5, 2018.
