Terms and Conditions
Please note: The dietary supplements offered on the hardmass.cz website are intended for direct consumption as dietary supplements in accordance with their stated purpose of use; the manufacturer disclaims liability for the consequences caused by improper dosage or use in combination with alcohol, drugs or narcotics, or in the event of deteriorated health. The products are intended exclusively for persons over 18 years of age.
General Provisions
These Terms and Conditions (hereinafter referred to as the "BTC") govern the mutual rights and obligations of the Seller and the Buyer arising in connection with or on the basis of a purchase contract concluded remotely through the hardmass.cz online store. The Seller is USA NUTRITION GROUP LLC, Northwest Registered Agent LLC, 90 State Street, Suite 700, Office 40, Albany, NY, 12207, United States of America (hereinafter referred to as the "Seller").
The Seller is responsible for delivering the goods to the end customer, arranging transport, communicating with customers, advising on the purchase of products and handling complaints related to orders.
Legal relations between the seller and the buyer who is a consumer are governed in particular by Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "CC"), and Act No. 634/1992 Coll., on Consumer Protection, both as amended. The seller complies with the rules set out in the European Union law for distance contracts vis-à-vis the seller's registered office outside the EU.
By concluding the purchase contract, i.e. by confirming the order, the buyer agrees with these BTC and undertakes to comply with them.
Definitions of basic terms
"Buyer" means a natural or legal person who has ordered and paid for goods through the hardmass.cz online store.
"Consumer" means a buyer who, outside the scope of his business or outside the framework of the independent exercise of his profession, enters into a contract with the seller or otherwise negotiates with him.
"Goods" means products ordered through the hardmass.cz online store.
Ordering and concluding a contract
The Buyer selects the goods in the hardmass.cz online store. The contractual relationship between the Seller and the Buyer is established by the Seller's confirmation of the order (by e-mail) to the Buyer. The Seller confirms the establishment of the contractual relationship no later than 24 hours from the receipt of the order. Further information on the order is sent to the Buyer at the e-mail address provided.
The Buyer is obliged to fill in all the information in the order truthfully and accurately; otherwise, he is responsible for the non-delivery of the goods or any damage incurred by the Seller as a result of incorrectly or incompletely provided data.
Order cancellation and withdrawal
The order can be cancelled free of charge until it is confirmed by sending an e-mail to info@hardmass.cz.
The Seller has the right to cancel the order and withdraw from the contract if, due to the unavailability of the goods or with all efforts that may be required of him, he is unable to deliver the goods to the buyer within the required period or at the price specified in the online store. The purchase price already paid or part thereof will be returned to the buyer within 14 days of the effective cancellation of the order.
The consumer has the right to withdraw from the contract without giving a reason within 14 days from the date of receipt of the goods, in accordance with Section 1829 of the Civil Code. For the purpose of exercising the right of withdrawal, the consumer must inform the seller of his withdrawal in the form of an unambiguous statement (by letter sent by post or e-mail to info@hardmass.cz) before the expiry of this period.
Within the specified period, the consumer has the right to unpack and test the goods in a manner similar to that usual when buying in a brick-and-mortar store, to the extent necessary to determine the nature, properties and functionality of the goods. The consumer is responsible for the decrease in the value of the goods as a result of handling them in a manner other than is necessary for this determination.
The buyer will send the goods back at their own expense in a safe way (courier service, in person...) to the address that will be communicated to them in writing or electronically, no later than 14 days after withdrawing from the contract. We recommend insuring the goods and sending them including all documents received during the purchase.
For hygienic reasons, it is not possible to return nutritional supplements with damaged original packaging.
Delivery conditions
The buyer has the choice of transport by courier company. Goods in stock are usually sent within 48 hours of receiving the order. If the goods specified in the order are not in stock, the buyer will be informed about this.
The buyer is obliged to take over the goods from the carrier; we recommend checking the integrity of the shipment and contacting the seller immediately in case of discrepancies. The shipment includes an invoice/tax document.
Prices and payment terms
All prices of goods and fees listed in the online store include VAT. The seller reserves the right to change the prices of the goods; the buyer has no right to additionally demand a different price than the one stated at the time of ordering.
The buyer can pay for the ordered goods:
- cash on delivery — cash on delivery to the courier, fee 5 €,
The amount of shipping according to the value of the order:
- order up to 150 € — postage 3,00 €,
- order over 150 € — free shipping.
Legal warranty and complaints
The rights and obligations of the contracting parties regarding the rights arising from defective performance and quality guarantee are governed by the Civil Code and are regulated in detail in a separate complaint procedure.
Privacy & Cookies
The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) — details can be found in the Privacy Policy. Information on the use of cookies on this website is provided in the Cookie Policy.
Responsibility
The seller is not responsible for non-delivery of the shipment or for its delay if it was caused by defects on the buyer's side — for example, an incorrect delivery address or telephone contact. By concluding the purchase contract, the buyer declares that he meets the age requirement of 18 years.
Out-of-court dispute resolution
The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID No.: 000 20 869, internet address: www.coi.cz, is competent for the out-of-court settlement of consumer disputes arising from a purchase contract. The online dispute resolution platform located at the ec.europa.eu/consumers/odr website can be used to resolve disputes between the seller and the buyer arising from the purchase contract.
Final provisions
The Seller reserves the right to change these Terms and Conditions; the change will be announced by publication on the hardmass.cz website. These Terms and Conditions are valid and effective from 1.12.2023.
